1. Acceptance of Terms
By installing or using MigrationMonitor ("the App"), you agree to these Terms of Service. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these terms.
2. License Grant
Appcento grants you a limited, non-exclusive, non-transferable license to use the App within your Jira Cloud instance, subject to these terms and your subscription plan. This license does not include the right to resell, sublicense, or redistribute the App.
3. Subscription and Billing
Paid subscriptions are billed through the Atlassian Marketplace. Appcento does not directly process payment information. Refunds are handled according to Atlassian's Marketplace refund policy. You may cancel your subscription at any time through the Atlassian Marketplace.
4. Acceptable Use
You may use the App for legitimate business purposes within your Jira Cloud account. You agree not to:
- Use the App for any unlawful purpose or in violation of Atlassian's Terms of Service
- Attempt to reverse-engineer, decompile, or disassemble the App
- Use the App to access data from Jira instances you do not own or administer
- Interfere with or disrupt the App's functionality or Atlassian's infrastructure
5. Data Handling
The App runs entirely within your Jira Cloud instance via Atlassian Forge. All data processing occurs within Atlassian's infrastructure. The App does not store, transmit, or process data outside of your Jira Cloud instance. See our Privacy Policy for complete details.
6. Limitation of Liability
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. IN NO EVENT SHALL APPCENTO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF BUSINESS, OR BUSINESS INTERRUPTION.
Appcento's total liability for any claims arising from or related to the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.
7. Warranty Disclaimer
APPENTO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or completely secure.
8. Indemnification
You agree to indemnify and hold harmless Appcento and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these terms.
9. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the federal or state courts located in San Francisco County, California.
10. Changes to Terms
We may update these terms from time to time. Any material changes will be communicated via email or through the App. Continued use of the App after changes constitutes acceptance of the updated terms.
